Aryan Khan Bail | Sameer Wankhede Twist

Aryan Khan Bail - Case Study

Aryan Khan Bail - Case Study

Hello, friends! Since the very beginning, there have been accusations on Aryan Khan's case that this case is politically motivated. And absolutely pointless. And now there has been a new revelation that raises more questions about the credibility of this case. The NCB officials are accused of demanding bribes. Bribes amounting to millions. What is the new revelation and what are the new updates? Come, let's understand them in today's article. "A new twist in Aryan Khan's case." "A new twist." "A bizarre twist in the Aryan Khan case." "One of the witnesses in the case, Prabhakar Sail, has made very strong allegations against the Narcotics Control Ward Zonal chief Sameer Wankhede. And also a private detective KP Gosavi. In an affidavit."

As you know, on 2nd October, the Narcotics Control Bureau, NCB had raided a cruise ship where some people were arrested in connection with drugs. One of them was the Bollywood star Shahrukh Khan's son Aryan Khan. And he was kept in police custody for some days. On 8th October, the Magistrate court denied his bail saying that his bail application wasn't maintainable. And the accused should approach the special NDPS court for bail. I explained the story here in the previous article. You can go read it. What happened after it?

The NDPS Act stands for Under this Act enacted in 1985, Aryan Khan and some other people were booked. And there are some special courts for it that hear cases related to this. That is the special NDPS court. When the hearing took place in this court, the court took a long time to reach a decision. They said that they would pronounce their judgment after the Dusherra holidays. And when the day finally came, on 20th October, the day when the special NDPS Court pronounced its judgment, they rejected the bail application of Aryan Khan. Along with his friend Arbaaz Merchant and model Munmun Damecha. On social media, people were very shocked about the judgment of the court.

People compared this case with the case of Ram Bhakt Gopal. The Jamia shooter, who had literally tried to shoot someone in public, and this was captured on camera as well, but still, he got bail in the case of hate speech. This hate speech case took place after the shooting case. And here Aryan Khan's case, a man against whom there is no evidence yet of him consuming drugs or even possessing drugs, still, he is locked in jail for so many days without bail. Some people compared this case with Bharti Singh's case as well. Where stand up comedian Bharti Singh and her husband were caught with 86.5 grams of weed. And they had gotten a bail after a couple of days.

People questioned how it could happen that someone is caught with drugs in their possession 'drugs in their possession'  and they still got bail. So some people shared photos of Bharti Singh of how she was supporting a BJP election event. Asking if that was the reason. By the way friends, during the hearing of this special NDPS court, do you know what was being argued by the NCB? NCB said that on the WhatsApp chats of Aryan Khan, some messages were found that are incriminating evidence that Aryan Khan was about to consume drugs. And what was the evidence? That Aryan Khan and Arbaaz Merchant wrote, "we are going to have a blast" while talking to each other. Texting in English in such a way that the NCB assumed that 'blast' means to consume drugs. 6 grams of Charas was found with Arbaaz Merchant allegedly. According to the NCB. So the NCB claimed that since he was caught with charas, and because they had written that they were going to have a blast in the chat, it was proof enough that the two of them were going to consume the charas together.

Considering WhatsApp texts as evidence like this, for some insignificant thing that means something else if we talk in today's lingo, so people compared this case to Arnab Goswami's case as well. Arnab Goswami had clearly written in his WhatsApp chats that he was fixing TRP. Talking about sharing Indian military secrets, and paying off judges, and on Pulwama attack, he had written "This attack we won like crazy." But he was still not jailed for it. But anyway, all of this is what-about-ism. We can find thousands of cases to compare. Let us focus on this single case. And look at it from legal aspects. In legal terminology,  some people said that 'bail is the norm.' A person is considered innocent until he is proven guilty.

Some people gave its counterargument by saying that it is not so for NDPS cases. Under NDPS, it is presumed that a person is guilty and if the person has to prove his innocence, then the burden of that is on him. That's why it is difficult to get bail in those cases. So anyway, getting bail rejected from this court meant the next step would be to challenge the decision in High Court. And Aryan Khan's lawyer did this. 26th October, that is today, was the first hearing in the High Court. Before we talk about it, let's talk about another revelation that happened during this time. In the last video on Aryan Khan, I had told you that two private citizens were found with the NCB during the NCB raid. One of them was Manish Bhanushali. A BJP politician. He was present there because he was allegedly giving tips to the NCB. And the other person was Kiran Gosavi.

A person who claims to be a private detective. And is absconding from the Pune police on charges of Cheating and Fraud. Where he had promised someone to give them a job but didn't do so. And now the latest update the latest revelation of this case is by a person named Prabhakar Sail. Who is he? He is actually a witness in this case. And the personal bodyguard of Kiran Gosavi. He says that after 22nd July, till now, he was the personal bodyguard of Kiran Gosavi. So during the raid on Aryan Khan, he was present there. He claims to have heard Gosavi on the phone with someone named Sam D'Souza. The conversation over the phone was about a demand of ₹25 crores. Wherein allegedly he was saying that they would have to settle at ₹18 crores because ₹8 crore needs to be paid to Sameer Wankhede. He is the Zonal Director of NCB. And has been in the news ever since Aryan Khan's case went public. "Then I understood that they were talking about ₹25 crores, of which ₹8 crores had to be paid tp Sameer Wankhede." How seriously does Prabhakar take this allegation? It can be seen when not only has he talked to the media about it, but he has also submitted a notarized affidavit in court.

In the document he submitted in the court, he has detailed the events of the day of the raid and where he was during the raid. And has given evidence supporting it. He claims that on the afternoon of 2nd October, the day of the raid, Gosavi had allegedly sent 10-12 photos to Prabhakar's phone, and asked him to identify if he knew any person who was supposed to board the cruise ship. Among the 10-12 photos. Sail said that he could identify Munmun Dhamecha only. After this, he says that after the raid, Gosavi was sitting in a white Innova car with the NCB officials, in which they were taking Aryan Khan to the NCB office. And Sail was in a car following them with D'Souza. To prove that he was present there at the time, he has shown a video as well and the video is now available on social media that he had shot on his phone.

In this video, Kiran Gosavi can be seen sitting with Aryan Khan holding a phone. It seems like Kiran Gosavi asked Aryan Khan to say something into the phone. After this, he accuses that Kiran Gosavi and Sam D'Souza had driven together where a blue Mercedes car came in which Shahrukh Khan's manager Puja Dadlani was sitting, Gosavi and D'Souza sit with her in the car and talk for 15 minutes. "When we reached Lower Parel, a blue Mercedes came behind us, I saw Puja Dadlani sitting in it. She's SRK's manager. Their meeting took about 15-20 minutes." The affidavit submitted in the court has many such details in it but in this video, I'm telling you only the main allegations. So the last allegation that I would like to tell you about, is that Prabhakar claims he was called at 1 in the morning when he got a call from Gosavi to go to the NCB office and sign as a witness.

Sameer Wankhede instructed him to sign his name and another officer, Salekar told him to sign his name on ten blank pages. And they asked for his Aadhar card as well. "Sameer Salekar put some papers in my hand and told me to sign them, I told him, "Sir, these are completely blank." How could I sign it? Wankhede came up then and told me to sing them quickly. Likely, they took my sign on 9-10 pages. They asked for my Aadhar card. I asked for his number and sent it on his WhatsApp." If these major accusations are true, then it is quite shocking news. In such a big case, millions of rupees are being asked as a bribe. Blank pages are being signed. The political motivation was evident from the outset Is this entire case staged? Created like a drama?

That is the biggest question to arise. Additionally, Prabhakar has claimed that Gosavi had last called him on 21st October. Then he told him that he wasn't present in the country. And his intention was to surrender to the police soon. Finally, he says that he is afraid of being murdered. Because in such major cases, witnesses often have the same fate. Witnesses disappear suddenly or get killed. NCB's Zonal Director Sameer Wankhede denies all these allegations. India Today's reporter Ashutosh Mishra got in touch with KP Gosavi. And talked to him. KP Gosavi claims that his life is under threat as well. But he doesn't say who is threatening him. He claims that he didn't know about Sameer Wankhede at the beginning. "On India Today, in this exclusive conversation, he says now he is getting threatening calls. Though he did not disclose who are those people even threatening that he could be killed inside the jail if he is arrested. He is now alleging and accusing Prabhakar. His own aid, his security personnel." He is accusing his bodyguard Prabhakar Sail that it was Sail that had actually demanded money. During all this, a lawyer writes to Mumbai Police that there should be an FIR registered against Sameer Wankhede regarding these allegations. And Sameer Wankhede wrote to the Mumbai police that he should get protection because he is being framed in this case.

What is the truth here? Only time will tell. For now, the NCB has ordered a Vigilance Inquiry against Sameer Wankhede, meaning an internal investigation on Sameer will take place. This inquiry will be supervised by the Deputy Director-General of NCB Gyaneshwar Singh. When he was asked if Sameer Wankhede would remain at his post, he said that it would be premature to comment on it. And that it would be decided after the inquiry. On the other hand, in the hearing that took place in the High Court today, the former Attorney General, Mukul Rohtagi was representing Aryan Khan.

In this hearing, NCB argued that Aryan Khan couldn't get bail because the evidence had been tampered with. The allegations against Sameer, are proof that there is an attempt to interfere in this case, so Aryan Khan should not get bail. Additionally, they used the argument that Aryan's friend Arbaaz was found with drugs in his shoe. Meaning that it is 'Conscious Possession' by Aryan. Mukul Rohtagi questioned its logic. Arbaaz isn't Aryan's servant. If drugs were found in Arbaaz's shoes, how can it be constructed to be 'Conscious Possession' by Aryan? After hearing the arguments of both sides, the court said that the hearing would continue tomorrow. And this is the latest update.

Thank you very much.
